When Does Statutory Severance Entitlement Arise?

Under the Labour Code, severance pay is granted only in cases expressly stipulated by law.

You are typically entitled to severance pay where your employment is terminated by notice given by the employer (or by mutual agreement) for one of the statutory reasons.

You are also entitled to severance pay if you, as the employee, terminate the employment with immediate effect for a statutory reason (most commonly due to unpaid wages).

What Is the Statutory Amount of Severance Pay?

Where employment is terminated by notice:

  • One month’s average earnings – if employment lasted less than 1 year
  • Two months’ average earnings – if employment lasted between 1 and 2 years
  • Three months’ average earnings – if employment lasted more than 2 years

Where employment ends for health reasons caused by the employer’s operations (e.g. occupational disease or workplace injury):

  • Twelve months’ average earnings
