Employee entitlements
The Labour Code grants employees enhanced protection. However, as the weaker party to the contract, the employee is often unaware of the extent of his or her rights. The protection of the employee's rights is therefore faced with a lack of information which the employee has no way of finding out without the help of a specialist. The employee thus loses the advantage of his position under the law. Even if the employee is in the right, he is unable to exercise his rights.
The only thing the employee lacks in these cases is a stable partner to turn to in case of a problem. Fear of failure and lack of knowledge tend to be the reasons why employees do not pursue their claims.
A significant barrier is the employee's weaker economic position vis-à-vis the employer (and former employer). The employee often lacks the resources to litigate. It is with an awareness of the employee's unequal position vis-à-vis the employer and to balance the employee's chances of achieving justice that we have decided to balance the forces through our contribution.
